CART RENTAL POLICY
Golf Cart Rental Contract Policies

1. Golf Vehicles — Renter Responsibilities

Golf vehicles shall be the responsibility of the renter. Renter is responsible for the return of golf vehicles in good working order without damage. Lost, broken, stolen, modified, altered or damaged golf vehicles by the renter will be the responsibility of the renter through its Certificate of Insurance. Furthermore, if a golf vehicle is found to be in need of repair at the conclusion of the rental term, then such damage is the responsibility of the renter. It is the responsibility of the renter to continue the rental until the date when the repair is promptly complete. Finally, the renter must provide a secured, predetermined area for the parking and maintenance of all golf vehicles. Vehicles sent to be used on the outer islands must be in working order prior to being returned. Shipping port will not accept or ship broken, non-working, unsafe, or discharged vehicles. Furthermore, gas operated golf vehicles with more than a quarter (1/4) tank of gas will not be accepted for shipping at the port.

2. Golf Vehicle Chargers/Gas

(Electric) Golf vehicles rented for more than 24 hours will be issued a golf vehicle charger.

Renter is responsible for the return of each charger in good working condition without damage. Lost, broken, stolen or damaged chargers will be the responsibility of the renter through its Certificate of Insurance. Furthermore, the renter will provide power and all fixtures to distribute power to all golf vehicle chargers equal to the amount of golf vehicles ordered for the term of the rental contract. Finally, renter will provide an equal amount of folding chairs to golf vehicles for the weatherproofing of all chargers. Chargers are located under the driver seat and must be replaced there for safe transportation.

(Gas) Golf/Utility Vehicles rented for more than 24 hours will be assessed post event for all fuel consumed during the rental term if the vehicle is returned with less than a full tank. Fuel will be billed at a rate of $5.95 plus tax per gallon in addition to a service fee of $25.00 plus tax per vehicle.

3. Golf Vehicle Keys

One key will be issued to each golf vehicle. Renter is responsible for the return of the allotted keys to Nohokai Production Services Inc. (NPS) in undamaged and working condition. If the keys are lost or damaged, then the renter agrees to replace each lost or damaged key at a rate of $5.00 plus tax per key and any associated cost in replacing keys.

4. Transportation of Golf Vehicles

Renter agrees that NPS is responsible for the coordination of transportation of golf vehicles to and from the job site. Furthermore, renter and NPS agree that at the conclusion of the outsourced transportation services that the renter shall reimburse in full NPS for any and all costs incurred for golf vehicle transportation.

5. Golf Vehicle Inspection

Renter represents and warrants that all vehicles are in working order and free of damage. Renter shall inspect all golf vehicles prior to signing this contract as to acknowledge that all golf vehicles are free of damages and are in good working condition. The renter will be responsible through its Certificate of Insurance for golf vehicles in its sole care, custody and control to include loss, damage, and replacement parts as well as labor charges sustained during the term of this rental agreement.

6. Payment

Upon the execution of this rental agreement, the renter shall tender to NPS payment in the total amount. Upon the return of the golf vehicles, the renter and an agent of NPS shall conduct a co-inspection to determine if there is any loss or damages to the golf vehicles, chargers and/or keys caused by the renter. If at the conclusion of the co-inspection of golf vehicles there is no such loss or damage that has occurred, the rental agreement shall be fulfilled and closed.

7. Post Event Golf Vehicle Cleaning TBD

Upon the conclusion of the event the renter agrees that rental golf vehicles will be cleaned by NPS at a cost of $22.00 plus tax per vehicle. It is the responsibility of the renter to remove any and all signs, decals, stickers, glue, tape residue or any device connected to the vehicle which is applied by the renter. (THE USE OF CLEAR PACKING TAPE ANYWHERE ON THE VEHICLE IS STRICTLY PROHIBITED.) Furthermore, returning vehicles from neighbor islands must be cleaned prior to arriving at the neighbor island port. Vehicles denied at the port due to insufficient cleaning will incur additional fees for storage, cleaning, and transportation. A co-inspection will be conducted by the renter and agent of NPS to quantify further Post Event Cleaning if necessary.

8. Waiver of Liability

Renter acknowledges and agrees that the renter shall be solely responsible for the proper use and operation of golf vehicles while such vehicles are in the sole care, control and custody of the renter during the term of this rental agreement. Furthermore, renter agrees to indemnify and hold harmless NPS from any and all liability, Workers Compensation, and or damages arising from the use and operation of golf vehicles by the renter during the term of this agreement except to the extent due to the negligence and willful misconduct of NPS. Renter shall also name NPS as an additional insured party under its general liability coverage and provide a Certificate of Insurance to NPS indicating such coverage.

GENERATOR RENTAL POLICY

Generator Rental Contract Policy

1. Generators ~ Renter Responsibilities

Rented generator(s) shall be the responsibility of the renter. Renter is responsible for the return of generator(s) in good working order without damage. Lost, broken, stolen, modified, altered or damaged generator(s) by the renter will be the responsibility of the renter through its Certificate of Insurance (COI). If renter does not provide insurance or a COI, then a refundable security deposit equivalent to the full cost of the unit is required. Furthermore, if a generator unit is found to be in need of repair at the conclusion of the rental term, then such damage is the responsibility of the renter. It is the responsibility of the renter to continue the rental until the date when the repair is promptly complete. Finally, the renter must provide a secured, pre-determined area for the placement, maintenance, and use of generator(s). Generator(s) sent to be used on the neighbor islands must be in working condition prior to being returned. Shipping port will not accept or ship generator(s) with more than a quarter (1/4) tank of gas.

2. Generator Fuel

Generator(s) rented will be assessed post event for all fuel consumed during the rental term if the equipment is returned with less than a full tank. Fuel will be billed at a rate of $5.95 plus tax per gallon in addition to a fuel service fee of $25.00 plus tax per generator.

Renter either provides his/her own transportation of generators, or agrees that NPS will be responsible for the coordination of transportation of generator(s) to and from the job site. Furthermore, renter and NPS agree that at the conclusion of the transportation services that the renter shall reimburse in full NPS for any and all costs incurred for generator transportation.

Renter shall inspect generator(s) prior to signing this contract as to acknowledge that generator(s) is/are free of damages and is/are in good working condition. The renter will be responsible through its Certificate of Insurance for generator(s) in its sole care, custody and control to include loss, damage, and replacement parts as well as labor charges sustained during the term of this rental agreement.

(THE USE OF CLEAR PACKING TAPE ANYWHERE ON THE GENERATOR IS STRICTLY PROHIBITED.) Furthermore, returning generator(s) from the neighbor islands are required to be cleaned and mandated to contain a quarter (1/4) or less tank of fuel prior to arriving at the neighbor island port. Generator(s) denied at the port due to insufficient cleaning or with more than a quarter tank of fuel will incur additional fees for storage, cleaning, and transportation. A co-inspection will be conducted by the renter and an NPS agent to quantify further Post Event Cleaning if necessary.
